The Supreme Court affirmed Defendant’s conviction for first-degree premeditated murder, holding that there was no abuse of discretion.On appeal, Defendant argued that the district court abused its discretion when it (1) declined to excuse a juror who, after the trial began, realized that she knew a witness and had been exposed to news coverage of the shooting; and (2) improperly excluded reverse-Spreigl alternative-perpetrator evidence. The Supreme Court disagreed, holding (1) the district court did not abuse its discretion in declining to remove the juror at issue from the jury; and (2) the district court did not abuse its discretion by excluding the reverse-Spreigl evidence.
