The Supreme Court affirmed the court of appeals’ decision to uphold Defendant’s conviction for second-degree intentional murder but reversed the court’s reversal of Defendant’s sentence of 480 months in prison. The court of appeals concluded that the district court abused its discretion when it imposed the sentence, which reflected an upward durational departure from the presumptive range for 312 to 439 months, and remanded for resentencing. The Supreme Court held (1) the court of appeals properly affirmed Defendant’s conviction; and (2) the district court did not abuse its discretion when it concluded that there was a sufficient basis to enhance Defendant’s sentence from the presumptive guidelines range.
